Petitioner prays for bail in connection with Paharpur P.S.Case No. 114 of 2014 registered for the offences punishable under Sections 341, 323, 324, 326, 307, 504, 379, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner and other accused persons is of indiscriminate firing on the informant and petitioner is accused in 12 other cases.

Submission of learned counsel for the petitioner is that there is no specific allegation against the petitioner and informant himself is accused in 24 cases and petitioner is in custody since 30.5.2018 and similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court vide order dated 31.5.2016

Patna High Court Cr.Misc. No.60738 of 2018 (2) dt.06-10-2018 2/2 passed in Cr.Misc.No. 22883 of 2016.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Paharpur P.S.Case No. 114 of 2014, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
