The petitioners seek bail in a case registered for offences under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 50 litres of mahua liquor was recovered from outside the village beneath a tree near "Pain" (ditch) from where four persons were apprehended including the petitioner. It is contended that nothing has been recovered from the conscious possession of
Patna High Court Cr.Misc. No.59772 of 2018(2) dt.06-10-2018 2/2 the petitioners. It is contended that the petitioners have no criminal antecedent. It is urged that the petitioners are in custody since 19.08.2018.
Considering the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on their furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna in connection with Signori P.S. Case No. 60 of 2018 (Special Case No. 7593 of 2018) with a condition that if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
