The petitioner apprehends his arrest in connection with Sheosagar P.S. Case No. 305 of 2019, registered under Section 30(a) of the Bihar Excise Act.

The accusation is of recovery of 220 bottles each containing 180 ml Indian made foreign liquor from the dilapidated house of Mahendra Singh. The said dilapidated house was being used by the petitioner.

Learned counsel for the petitioner submits that the seized 220 bottles each containing 180 ml Indian made foreign liquor are said to be recovered from the dilapidated house of Mahendra Singh but due to dirty village politics, the present

Patna High Court CR. MISC. No.64087 of 2019(2) dt.18-10-2019 2/2 case has been lodged with false allegation. Moreover, petitioner has no criminal antecedent, except Sheosagar P.S. Case No. 305 of 2019, which is also similar nature of present case. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
