JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Complaint Case No. C-153 of 2016 registered for the offences punishable under Sections 406, 417 of the Indian Penal Code. The contents of complaint petition go to show that it was petitioner no. 1 who played entire game and it was he, who took the complainant to Delhi and gave him forged Passport and Visa. So far as petitioners no. 2, 3 and 4 are concerned, they appear to be family members of petitioner no. 1 and no serious allegation has been levelled against them.

No.59904 of 2018(2) dt.14-12-2018 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that petitioner no. 2, namely, Naveen Kumar, petitioner no. 3, namely, Jatadhari Lal Singh @ Jatadhari Lal and petitioner no. 4, namely, Lal Bahadur Singh, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Raxaul at Motihari in Complaint Case No. C-153 of 2016, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
