JUSTICE SANJAY PRIYA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sherghati (Dobhi) P.S. Case No. 719 of 2017 instituted for the offence under Section 392 of Indian Penal Code.
It is alleged in the written report that one Motorcycle has been recovered from the house of the petitioner. Counsel for the petitioner submits that petitioner is not named in the written report. He has no criminal antecedent. His name has come in the confessional statement of co-accused Birendra Kumar. He has disclosed before the police on his arrest that he sold the Motorcycle to the petitioner. Counsel for the petitioner further submits that petitioner has purchased the Motorcycle in question from co-accused Birendra Kumar on
Patna High Court Cr.Misc. No.59808 of 2018 (2) dt.06-10-2018 2/2 consideration money of Rs.20,000/- and paper of the vehicle has been prepared.
Petitioner is said to be in custody since 27.04.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati, Gaya, in connection with Sherghati (Dobhi) P.S. Case No. 719 of 2017, subject to the condition that both the bailors will be close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
