JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 15-11-2019 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest for the offences alleged under Sections 272, 273 and 308/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016 registered in connection with Pachrukhi P.S. Case No. 224 of 2019. As per written report submitted by one Umesh Prasad, Assistant Sub-Inspector of Police, Police Station Pachrukhi, the prosecution case is that on 24.08.2019 the informant received a secret information that the persons named in the FIR were busy in concealing a big consignment of prohibited wine. For verification, the police reached near the house of Ramshish Sharma and on seeing the police jeep, 5-6 persons were trying to flee away. Police chased them but they succeeded to flee away by taking advantage of maize crops and bamboo orchard. Thereafter in the field of Ramayan Sah
Patna High Court CR. MISC. No.66825 of 2019(2) dt.15-11-2019 2/3 from a Khop, total 1279.920 litres of foreign wine was recovered. Learned counsel for the petitioner submits that the petitioner has neither been apprehended on the spot nor anything has been found in conscious possession of the petitioner and he has no concern with the place from where the alleged recovery has been made. He further submits that in fact, recovery of 1279.920 litres of foreign wine has been made from the field of Ramayan Sah. It is further submitted that the petitioner is running a Gym near the police Station Pachrukhi and some policemen wanted to utilize his Gym without cost due to which petitioner has been falsely implicated in this case. He further submits that the entire prosecution case against the petitioner is false, fabricated and concocted due to village politics and pressure of the local police. The petitioner has no criminal antecedents.
In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, subject to deposit of Rs. 20,000/-( Rupees twenty thousand) in the court below and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, (Excise), Siwan in connection with Pachrukhi P.S. Case No. 224 of 2019, subject to the conditions as laid down under
Patna High Court CR. MISC. No.66825 of 2019(2) dt.15-11-2019 3/3 Section 438 (2) of the Cr.P.C.
Such deposit of Rs. 20,000/- shall abide by the outcome of the criminal case.
