Heard learned counsels for the petitioner and the State.

Petitioner seeks bail in connection with Muzaffarpur Town P.S. Case No. 17 of 2018 registered for the offence punishable under sections 302/34, 120B of the Indian Penal Code and sections 25(1-b)A, 26, 35 and 27 of the Arms Act. Learned counsel appearing for the petitioner submits that nothing has been recovered from the conscious possession of this petitioner nor he has been put on Test Identification Parade till date. Except the confessional statement

Patna High Court Cr.Misc. No.60942 of 2018(2) dt.08-10-2018 2/2 of the co-accused on basis of which petitioner has been implicated in this case there is nothing against this petitioner. Similarly situated co-accused persons have been granted bail by this Court vide order dated 23.07.2018 (Annexure-2) and 14.08.2018 (Annexure-3) passed in Cr. Misc. 33737 of 2018 and 39431 of 2018 respectively. Petitioner has no criminal antecedent and is in custody since 16.01.2018. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Town P.S. Case No. 17 of 2018.
