Petitioner prays for bail in connection with Bousi P.S.Case No. 12 of 2016, corresponding to Sessions Trial No. 114 of 2018, registered for the offences punishable under Sections 328 and 302/34 of the Indian Penal Code.

Allegation against three accused persons, including the petitioner is of administering poison to the deceased and causing his death.

Submission of learned counsel for the petitioner is that against two accused persons, out of three, final form has been submitted finding case not true against them and they have been granted anticipatory bail by the court below and petitioner is in custody for five months.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the 3rd Additional District and Sessions Judge, Araria, in connection with Sessions Trial No. 114 of 2018, arising out of Bousi P.S.Case No. 12 of 2016, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
