The petitioner apprehends his arrest in Ramnagar P.S. Case No.53 of 2019 registered under Sections 20B and 22A of the N.D.P.S. Act.

The informant disclosed that he had got information of carrying ganja by four persons. On such, the informant and other police officials reached at Banjariya Canal to verify the information. The informant saw four persons coming. Two of them were carrying bags in their hands. All the four persons started fleeing away after seeing the police. Two persons, who were carrying bags in their hands, were apprehended on chase and 4.75 kg and 5 kg ganja was recovered from two apprehended accused persons.

Learned counsel for the petitioner submits that the apprehended accused persons disclosed the names of the

Patna High Court CR. MISC. No.70652 of 2019(2) dt.18-12-2019 2/2 petitioner Bablu Khan and Sadre Alam. Sadre Alam has already been enlarged on anticipatory bail by this court vide order dated 10.07.2019 passed in Cr.Misc.No.42621 of 2019. The case of the petitioner stands on same footing as that of Sadre Alam. Having considered the facts that the informant himself stated that only two persons were carrying bags, who were apprehended and 4.

75 kg and 5 kg ganja was recovered from possession of two apprehended accused and the petitioner managed to flee away although nothing was recovered from possession of the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bettiah, West Champaran in connection with N.D.P.S. Case No.13 of 2019 arising out of Ramnagar P.S. Case No.53 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
