====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 31-01-2024 Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks regular bail in connection with Imamganj P.S. Case No.248 of 2022, registered for the offences punishable under Sections 341, 323, 504, 506 & 387/34 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner is that he alongwith two other accused persons came at the bridge construction site and started assaulting the labourer and told to stop the said construction work. It is further alleged that about 5 months ago the petitioner had demanded Rs.1,00,000/- as extortion money from the contractor.

4. Learned counsel for the petitioner submits that the

No.71562 of 2023(3) dt.31-01-2024 2/2 petitioner is innocent and has been falsely implicated in this case due to his criminal antecedents of four cases in which he is on bail. He further submits that except the confessional statement there is no material against the petitioner. He also submits that petitioner is in jail custody since 07.06.2023, charge sheet has already been submitted in this case and there is no chance of absconding the petitioner or tampering with the evidence.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.-Ist Class, Sherghati, Gaya in connection with Imamganj P.S. Case No.248 of 2022.
