The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 188, 379 of the Indian Penal Code and section 7/8 of the Bihar Minerals (Prevention of Illegal Mining Transportation & Storage) Act. As per the prosecution case, petitioners are alleged to have illegally stored the sand in the land of Bihar Government and involved in illegal business of sand.

It is submitted that petitioners are not named in the

Patna High Court CR. MISC. No.5213 of 2023(2) dt.09-05-2023 2/2 FIR. During course of investigation on the statement of Anchal Amin and Halka Karmchari the name of petitioners transpired in this case. Petitioners have got no concern with the alleged sand or from the place where sand was found stored. Petitioners are farmers and have got no concern with the alleged recovery. Petitioners claim clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-cum-Additional Munsif, Dehri, Rohtas in connection with Darihat P.S. Case No. 56 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
