====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 06-10-2018 Heard learned counsels for the petitioner and the State.

Petitioner seeks bail in connection with Hajipur Industrial Area P.S. Case No. 85 of 2018 registered for the offence punishable under sections 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case due to local politics. The Investigating Officer has submitted final form against this petitioner vide Final Form No. 96 of 2018, dated 16.08.2018 and concluded that there is no any charge made out under Section 302, 120B of the I.P.C. and Section 27 of the Arms Act against this petitioner (Annexure-2).

Patna High Court Cr.Misc. No.61028 of 2018(2) dt.06-10-2018 2/2 Petitioner has no criminal antecedent and is in custody since 22.05.2018.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Industrial Area P.S. Case No. 85 of 2018.
