JUSTICE RAKESH KUMAR ORAL ORDER 28-09-2018 Heard Sri Murari Narain Chaudhary, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Saharghat P.S. Case No. 94 of 2018 registered for offence under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender. At the very outset, learned counsel for the petitioner has drawn my attention to the statement made in paragraph-3 of the petition to show that the petitioner is having clean antecedent. He further submits that in this case, one Santro car and Hero Honda Splendor motorcycle were seized by the police with huge quantity of Nepali country-made liquor and the petitioner only on suspicion has been made accused. Patna High Court Cr.Misc. No.60155 of 2018(2) dt.28-09-2018 2/2 counsel for the petitioner has drawn my attention to the statement made in paragraph-7 of the petition to show that petitioner is having no concern either with seized vehicles or liquor.
Considering the facts and circumstances, particularly the fact that petitioner is having clean antecedent as well as the statement made in paragraph-7 of the petition, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner, namely, Sukesh Mahto @ Sukesh Kumar Mahto be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge- 2nd -cum-Special Judge, Excise, Madhubani/concerned court in connection with Saharghat P.S. Case No. 94 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
