The petitioners seek bail in a case registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 16.5 litres foreign liquor was recovered from the bag of the petitioners. It is further contended that nothing was recovered from the conscious possession of the petitioners and their names have been dragged in this case at the instance of their enemy. Petitioners claim that they are having clean antecedent and are in custody since 29.08.2018.

Having regard to the facts and the circumstances of

No.62247 of 2018(2) dt.08-10-2018 2/2 the case, the abovenamed petitioners are directed to be released on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Kaimur at Bhabua in connection with Excise Case No. 765 of 2018 arising out of P.R. No. 34 of 2018-19.

Further, if the petitioners, after their release in this case, are again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of their bail bonds.
