The petitioners are apprehending their arrest in a case registered under Sections 147, 148, 149, 323, 307, 338, 353, 504 and 506 of the Indian Penal Code.

The prosecution allegation, in short, is that owing to dispute over road, the accused persons forming an unlawful assembly attacked on the police and caused disturbance in discharge of official duty.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no

Patna High Court CR. MISC. No.75039 of 2019(3) dt.08-02-2021 2/2 allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. Altogether 48 persons are named in the F.I.R. including the petitioners. General and omnibus allegation has been made against the petitioners. No specific overt act is alleged against the petitioners.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -II, Gaya, in connection with Alipur P.S. Case No. 32 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
