JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 29-02-2024 Heard learned counsel for the petitioners and learned APP for the State duly assisted by learned counsel for the informant.
2. Both accused-petitioners, named in the F.I.R., are apprehending their arrest in connection with Sherghati P.S. Case No. 575 of 2020 registered for the offences punishable under Sections 341, 323, 324, 307, 379, 506/34 of the Indian Penal Code. They have no criminal antecedent as stated in paragraph '3' of the application.
3. Allegation against the accused/petitioners is to assault the informant and others with an intention to kill him and also snatched golden chain of Rs. 50,000/-.

4. Learned counsel appearing on behalf of the petitioners submitted that petitioners have been falsely implicated in the present case. There is case and counter case between the parties, where both sides have received injuries. Learned counsel submits that the land dispute is pending between the parties. Petitioners have got clean antecedent. Learned counsel pointed out that similarly situated co-accused namely, Kajesh Singh has been granted privilege of anticipatory bail by one of the coordinate Bench of this Court in Cr. Misc. No. 25186/2023 vide order dated 28.07.2023.
5. Learned A.P.P. for the State duly assisted by learned counsel for the informant have opposed the prayer for anticipatory bail of the petitioners.

In view of the aforesaid factual submissions and by taking note of the fact as there is case and counter case between the parties and similarly situated co-accused namely, Kajesh Singh has been granted privilege of anticipatory bail by one of the learned coordinate Bench of this Court through Cr. Misc. No. 25186/2023 vide order dated 28.07.2023, accordingly, both above-named petitioners, in the event of their arrest/surrender within a period of four weeks from today, are directed to be enlarged on bail on furnishing of bail bond of Rs.10,000/- (ten
