1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners apprehend their arrest in connection with Complaint Case no.659 of 2023 registered under sections 420 and 323 of the Indian Penal Code.

3. The allegation against the petitioners is that the complainant had purchased 5/6 decimal of land from the petitioners for an amount of Rs. 40,000 in the year 17.07.2007. It has been alleged that she came to know in the year 2023 that one Mahesh Yadav was claiming his title over the said land.

4. Learned counsel for the petitioners submits that

It would be evident from the very complaint itself that the complaint has been lodged after a lapse of about 15-16 years of the date when the sale deed was executed by the petitioners to the complainant. Learned counsel for the petitioners further submits that the said land was initially running in the name of grand father of the petitioners and after sale of the said land to the complainant, the same has been running in the name of complainant and the complainant has been in peaceful possession of the land since the year 2007. The dispute is purely of civil in nature which has been raised in the form of complaint case after lapse of several years. The petitioners have no criminal antecedent and undertake to cooperate in the case/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

6. In view of the entire facts and circumstances of the case, it is directed that the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Complaint Case no.659 of 2023 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the
