Petitioner prays for bail in connection with Naubatpur P.S.Case No. 35 of 2018 registered for the offences punishable under Sections 399, 402, 307, 353 of the Indian Penal Code and Sections 25(1-B)(a), 26, 27 and 35 of the Arms Act. Allegation as per FIR is that police on information for preparation of committing dacoity raided the place and two persons were arrested and petitioner is named in the FIR and petitioner is accused in six other cases.

Submission of learned counsel for the petitioner is that other co-accused persons have been granted anticipatory/regular bail vide order dated 13.7.2018 passed in Cr.Misc.No. 40640 of 2018 by this Court and vide order dated 16.7.2018 passed in

Patna High Court Cr.Misc. No.60721 of 2018 (2) dt.06-10-2018 2/2 Cr.Misc.No. 34778 of 2018 by co-ordinate Bench of this Court and petitioner is in custody sine 28.6.2018 and petitioner has been granted bail in all those cases and charge sheet has been submitted in this case.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Danapur, Patna, in connection with Naubatpur P.S.Case No. 35 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
