JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-06-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State assisted by learned counsel for the informant through video conferencing. Petitioner is languishing in jail custody since 17.06.2019 in connection with Civil Lines P.S. Case No. 241 of 2019 registered for the offence punishable under Section 365 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, allegedly, mobile phone of the deceased was recovered from possession of co-accused Jawed, who disclosed that he had purchased the said mobile from the petitioner. Subsequently, petitioner was arrested and confessed

However, learned counsel appearing for the informant submits that in his confessional statement, petitioner confessed this fact that he as well as co-accused had killed the deceased at the direction of husband of the deceased.

Taking note of this fact that except so-called confessional statement, that too, before the police, there appears to be nothing against the petitioner, against whom the investigation has already been completed, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Civil Lines P.S. Case No. 241 of 2019.
