Petitioner seeks bail in Patori P.S. Case No.418 /16 registered for the offence under Sections 147, 148, 324, 302 of I.P.C. and Section 27 of Arms Act.
Allegation as per the F.I.R. is that large number of named accused persons have surrounded the deceased and caused injuries to him who succumbed to injuries.
Submission on behalf of the learned counsel for the petitioner is that in the entire F.I.R. nothing has come against the petitioner he is said to be only member of mob who has not assaulted the deceased. Moreover,he is accused in two more other cases but he is on bail. Other co-accused persons have already been granted bail by this Court which will appear from paragraph
Patna High Court Cr.Misc. No.64883 of 2018 (2) dt.02-11-2018 2/2 10 of this petition. Petitioner is in custody since 27.07.2018. Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances of the case, stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Samastipur, in Patori P.S.
