The petitioner seeks bail in a case registered for offences under Section 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

It is contended that, as per allegation, 57 litres of foreign liquor was recovered from the possession of the petitioner. It is contended that the petitioner has no criminal antecedent. It is urged that the petitioner is in custody since 14.07.2018.

Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.62879 of 2018(2) dt.08-10-2018 2/2 satisfaction of the learned Special Judge, Excise Act, Patna in connection with Special Case No. 6419 of 2018 arising out of Bakhtiyarpur Rail P.S. Case No.80 of 2018 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
