Petitioner prays for bail in connection with Chakai P.S.Case No. 02 of 2018 registered for the offences punishable under Sections 25(1-B)(a), 26 and 35 of the Arms Act. Allegation is of recovery of one loaded pistol from the house of the petitioner and two accused persons, including the petitioner were arrested. Further it appears that petitioner is accused in three other cases also.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody since 12.1.2018 and similarly situated co-accused has already been granted bail by a co-ordinate Bench of this Court vide order dated 3.7.2018 passed in Cr.Misc.No. 36582 of 2018.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Jamui, in connection with Chakai P.S.Case No. 02 of 2018, subject to the condition that one of the bailors shall be a local close relative of the petitioner, having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that if petitioner is named accused in any other case in future, prosecution is given liberty to move for cancellation of his bail bond.
