JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2019 This is an application for grant of anticipatory bail in connection with Nayagaon P. S. Case No. 34 of 2005, disclosing offence under Sections 396 and 412 of IPC. As per F.I.R. though the petitioner is not named in the F.I.R., but later on, his name transpires during the investigation. It appears that case is under Section 302 IPC with serious allegation of looting of truck and also causing death of driver of the truck. The occurrence is of the year 2005. Submission of the learned counsel for the petitioner is that earlier charge sheet has not been submitted against the petitioner and investigation was pending. Later on, charge sheet was submitted against him and as such, he has no knowledge about the same, so he could not appear.
Heard learned A.P.P. also, who has opposed the prayer
Patna High Court CR. MISC. No.70895 of 2019(3) dt.22-11-2019 2/2 for anticipatory bail on the ground that it is the case of double murder. The name of the petitioner transpires in the year 2005, but still he was absconding.
Having heard both sides, in view of the allegations, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail, the same shall be considered on the basis of materials available on the case diary against him.
