1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The learned counsel for the petitioners at the outset seeks permission to withdraw the anticipatory bail application of petitioner no.1, namely, Sanjay Kumar @ Sanjay Mandal.

3. Permission is accorded.

4. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 341, 323, 327, 307, 354(B), 379, 384, 504, 506, 34 of the Indian Penal Code.

5. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and the informant alleges that Sanjay assaulted Ravi with an iron rod causing injury on his nose and face, thereafter also assaulted the informant by lathi causing injury on the shoulder, thereafter Shiv Ratan assaulted the father of the informant by lathi causing injury on shoulder and when the informant came to save his father, the accused Shiv Shankar Mandal carrying three-not pointed at the informant and when the lady members of the family came to save them, the accused acted inappropriately and even demanded ransom of Rs.20 lacs in lieu of vacating the house of the informant.

Learned counsel for the petitioners submits that from perusal of the allegation as alleged in the F.I.R. it would manifest that on account of dispute relating to land, the occurrence is alleged to have taken place in which both side assaulted each other. It is also submitted that even the injury suffered by the injured is simple in nature as would manifest from the injury report annexed as Annexure-3 series to the anticipatory bail application.

7. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

8. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Chausa P.S. Case No.235/2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
