The petitioner has prayed for bail in a case registered for the offence punishable under sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.
As per allegation in the FIR, on 4.5.2022 petitioner called informant's husband and on very next date, informant came to know that her husband was shot dead and the alleged pistol was later on recovered at the instance of the petitioner. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. No one is eye witness of the occurrence. Save and except suspicion, nothing is against the petitioner to show his involvement in the
Patna High Court CR. MISC. No.68840 of 2022(3) dt.22-03-2023 2/2 present case. Petitioner is languishing in judicial custody since 10.05.2022.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and considering above facts and the period of custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Samastipur in connection with N.H. Bangara P.S. Case No. 48 of 2022.
