JUSTICE SANJAY KUMAR ORAL ORDER 03-10-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner Raghuni Yadav has renewed his prayer of regular bail in connection with Sessions Trial No.222 of 2018 arising out of Pasraha P.S.Case No.24 of 2018 pending in the Court of Sessions Judge, Khagaria registered for an offence under Section 395 of the IPC on the ground that two co-accuseds whose name appeared in the confessional statement have been allowed bail by another coordinate Benches of this Court. This petitioner is in custody since 07.03.2018 having clean antecedent and so he also deserves bail.

Learned APP opposed the submissions.

On going through the impugned order, I find that on the basis of confessional statement of co-accuseds, the police seized a

Patna High Court Cr.Misc. No.60948 of 2018 (2) dt.03-10-2018 2/2 mobile phone belonging to the informant from the house of this petitioner. It was being used of his wife. There is no recovery from the possession of other co-accuseds who have been allowed bail by another coordinate Bench of this Court.

In the facts and circumstances, I am not inclined to reconsider his prayer for bail. Prayer is accordingly rejected. (Sanjay Kumar, J) B.Kr./- U T
