Petitioner seeks bail in Muffasil P.S. Case No.476 of 2017 instituted for the offence under Section(s) 272, 273 Indian Penal Code and Section 30-A of the Bihar Prohibition & Excise Act, 2016.

Counsel for the petitioner submits that name of this petitioner has been disclosed by Ramnath Sahani, who was caught on the spot. Petitioner has no concern with the alleged recovery of country made liquor.

It has further been submitted that aforesaid Ramnath Sahani has already been granted bail by co-ordinate Bench of this Court by order dated 04.12.2017 passed in Cr. Misc. No.56335 of

Patna High Court Cr.Misc. No.63210 of 2018 (2) dt.12-10-2018 2/2 2017.

Petitioner is in custody since 23.07.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Motihari, in connection with Muffasil P.S. Case No.476 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.
