Petitioners seek bail in Murliganj P.S. Case No.269 of 2018, giving rise to Excise Act Case No.740 of 2018, registered under Sections 30(a) and 41(i) of the Bihar Prohibition and Excise Act, 2016.
The informant alleged that on interception of the vehicle, the petitioners, who are driver and cleaner of the vehicle were apprehended and from the vehicle 315 litres of Indian made foreign liquor of different brands was recovered. The learned counsel for the petitioners submits that the petitioners are driver and cleaner of the vehicle. The vehicle was hired by Mukesh Yadav and Md. Arsad and they were
Patna High Court Cr.Misc. No.61455 of 2018(2) dt.06-10-2018 2/2 carrying Kurkure and Farhi. Inside the bag of Kurkure and Farhi the cartons of different brands of foreign liquor were kept. The petitioner had no knowledge about concealing liquor in the box of Kurkure and Farhi. Petitioners are in jail since 03.08.2018.
Considering the facts aforesaid and the fact that the petitioners are in jail for more than two months, petitioners, above named, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-II-cum-Special Judge, Excise Act, Madhepura in connection with Murliganj P.S.
