2. At the very outset, learned counsel for the petitioner prays for and is permitted to withdraw this application with regard to petitioner no. 3.

3. Accordingly, this application is dismissed as withdrawn with regard to petitioner no. 3 and this application is now restricted to petitioner no. 1 and 2 only. Heard learned counsel for the petitioner and learned APP for the State.

4. The petitioner no. 1 and 2 apprehends their arrest in connection with Lakhisarai (Ramgarh Chowk) P.S. Case No. 681 of 2023 registered for the offence under Sections 147, 148, 149, 307, 325, 354, 504 of the Indian Penal Code and later on Section 302/34 of the Indian Penal Code was also added.

5. It has been submitted by the petitioner no. 1 and 2 that final form was submitted against them and other accused persons after investigation but the Court below, after differing with the final form has taken cognizance against them.

6. Considering the fact that the police has exonerated the petitioner no. 1 and 2 and has submitted final form, this application is allowed.

7. Let the petitioner no. 1 and 2, above named, in the event of their arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Lakhisarai/concerned Court below in connection with Lakhisarai (Ramgarh Chowk) P.S. Case No. 681 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.
