2. The petitioner seeks bail in connection with Dhaka P.S. Case No. 13 of 2023 registered for the offence punishable under Section 392 of the Indian Penal Code.

3. The allegation against the petitioner is that he along with others criminals has looted Rs. 50,000/- from the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is not named in the FIR nor he was arrested from the spot. The petitioner has not been put on Test Identification Parade.

5. Learned counsel for the petitioner further submits that the petitioner undertakes to deposit Rs. 50,000/- in the

Patna High Court CR. MISC. No.71349 of 2023(2) dt.07-11-2023 2/2 Court below by way of demand draft in the name of the informant without accepting his guilt.

6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Sikrahana at Dhaka, DistrictEast Champaran, Motihari in connection with Dhaka P.S. Case No. 13 of 2023, subject to the condition that at the time of furnishing bail bonds, the petitioner shall produce a demand draft of Rs. 50,000/- issued in the name of the informant in the Court below. In turn, the Court below shall verify the genuineness of the demand draft and thereafter, hand over the same to the informant.
