2. The petitioner seeks regular bail in connection with Larjhaghat P.S. Case No. 23 of 2025 registered for the offence under Section(s) 137(2), 96, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the petitioner is accused of kidnapping the victim girl.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 29.05.2025. He further submits that though the petitioner is accused of kidnapping the victim girl but the victim and the petitioner have got married and they are staying together.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Rosera, Samastipur/concerned Court below in connection with Larjhaghat P.S. Case No. 23 of 2025 subject to conditions that:- (i). At the time of accepting the bail bonds of the petitioner, the Court below shall verify the factum of marriage of the petitioner with the victim and if the submission of the learned counsel for the petitioner is found true i.e., the victim and the petitioner have got married and are staying together then only the bail bonds of the petitioner shall be accepted otherwise appropriate order shall be passed by the Court below.
