The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Itarhi P.S. Case No. 40 of 1999, registered for the offence punishable under sections 304B, 201 and 34 of the Indian Penal Code.

As this application for grant of anticipatory bail has been filed in a case under section 304B of the IPC, which was registered on 08.05.1999, submission on behalf of the learned counsel for the petitioner is that the petitioner was not aware about the pendency of this application and in the meantime other co-accused who were tried, have been acquitted by the judgment brought on record as Annexure-2 to the application.
