The petitioner seeks bail in Belhar P.S. Case No.152 of 2014 registered under Section 302 and other Sections of the Indian Penal Code, under Section 27 of the Arms Act, under Section 38, 39 and 40 of the UAP Act and under Section 17 of the C.L.A. Act. The son of the informant alleged that some unknown persons clad in Commando dress having armed with different weapons came to his house and took his father to the house of Bhola Singh. The informant also followed them but on threatening, the informant returned but the informant heard alarm. Subsequently, the dead body of the father of the informant was found.
The learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.61558 of 2018 (2) dt.08-10-2018 informant did not name any accused persons in the F.I.R. Petitioner is also not named in the F.I.R. During the course of investigation, the name of the petitioner transpired on the basis of confessional statement of Arjun Yadav and Bechandev Yadav. Bechandev Yadav, Jagarnath Yadav and Arjun Yadav have been enlarged on bail vide order passed in Cr. Misc. No.60698 of 2017 and 38512 of 2018. The case of the petitioner stands on better footing as that of Bechandev Yadav and Arjun Yadav. Considering the facts that the name of the petitioner figured in the confessional statement of co-accused, Bechandev and Arjun, who have already been enlarged on bail, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Banka in connection with Belhar P.S.
