1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Baikunthpur P.S. Case No. 245 / 2025 dated 05.07.2025 registered under Sections 126(2) / 115 (2) / 118 (1) / 109 / 303
(2) / 352 / 351 (3) / 3(5) of the B.N.S.
3. As per the first information report on 30.06.2025 in the morning at about 10:30 A.M. due to dispute of cutting the branch of 'Jamun' tree, the accused persons armed with various weapons assaulted the father-in-law of the informant on his head due to which he became senseless and fell down on the ground and the petitioner assaulted the informant - Chandani Devi on her head by means of 'Daab' resulting in head injury.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence in the manner alleged. There is case and counter case between the parties inasmuch as Baikunthpur P.S. Case No. 244 / 2025 has been lodged against the informant and four others under Section 126(2), 115(2), 352, 351(3) & 5 of the B.N.S. by the side of the petitioner. The present F.I.R. has been lodged by the informant after more than five days delay on 05.07.2025 for an occurrence alleged to have taken place on 30.06.2025. The injury sustained by the informant is simple in nature. The petitioner has no criminal antecedent.
5. Regard being had to the submission made by the parties, taking into consideration the fact that injury sustained by the informant is simple in nature and the petitioner has no criminal antecedent, accordingly, I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Shikha Kumari, JM 1st Class, Gopalganj in connection with
