The petitioner seeks bail in connection with S. Tr. No. 857 of 2019 arising out of Athmalgola P.S. Case No. 40 of 2019, registered under Section 302/34 of the Indian Penal Code. The accusation is that Sidhant Kumar, three years old minor child of the informant, Priyanka, was playing in the courtyard. At that time, her father-in-law, Yugal Rai, mother-inlaw, Fuliya Devi (petitioner), brother-in-law, Jai Prakash Rai and Sumant Rai, pressed the neck of her son by folding rope. On hearing the cry of child, when the she rushed then found her son unconscious. At that time, Amrita Devi was also coming from the main door of the house.
Patna High Court CR. MISC. No.67427 of 2019(3) dt.22-01-2020 2/2 Submission is that the petitioner, who is mother-inlaw of the informant has falsely been implicated in this case mere on suspicion. The petitioner is lady and in custody since 05.03.3019 and the police on investigation ha already submitted the charge sheet.
Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with S. Tr. No. 857 of 2019 arising out of Athmalgola P.S. Case No. 40 of 2019 to the satisfaction of the Additional Sessions Judge, V, Barh, Patna.
