1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.
2. The petitioner apprehends his arrest in connection with Gaurichak P.S. Case No. 254 of 2022 registered under Sections 384, 386, 387, 34 of the Indian Penal Code and 25(1-b)A, 26, 35 of the Arms Act.
3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the instant case. From perusal of the Annexure-3, it appears that the house in question from where the alleged recovery has been made was given on rent. Further he submits that co-accused has already been allowed bail by a Co-ordinate Bench of this Court vide order dated 07.02.2023 passed in Cr. Misc. No. 42656 of 2022, as contained in
Patna High Court CR. MISC. No.74220 of 2023(2) dt.01-12-2023 2/2 Annexure-2 to the bail application.
4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-VI, Patna City, Patna in connection with Gaurichak P.S. Case No. 254 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
