Petitioner seeks bail in Madhuban P.S. Case No.308 of 2017, registered under Sections 376, 363 and 315/34 of the Indian Penal Code.
The father of the victim alleged that Tabrej Alam established physical relation with his daughter on the pretext of marriage but his daughter became pregnant. Mukhiya, Ranjeet Kumar and Parwez Alam, cousin of Tabrej Alam took his daughter to Dhanwantari Seva Sadan for abortion. The learned counsel for the petitioner submits that petitioner is not named in the FIR. During the course of investigation, the name of the petitioner figured in the case as the Manager of Dhanwantari Seva Sadan but no allegation is made against the petitioner that petitioner was anyway involved
Patna High Court Cr.Misc. No.61525 of 2018(2) dt.06-10-2018 2/2 for getting the daughter of the informant aborted. Considering the facts aforesaid and nature of allegations made against the petitioner and the fact that the petitioner is in jail since 20.07.2018, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, East Champaran, Motihari in connection with Madhuban P.S. Case No.308 of 2017.
