The petitioner seeks bail in connection with Forbesganj P.S. Case No. 257 of 2018, registered under Section 414 of the Indian Penal Code.

The accusation is that in course of patrolling duty informant came to know that habitual offender Billa Paswan (Petitioner) was seen at Goriyari along with theft motorcycle. Thereafter, informant and other Police officials reached at Goriyari chowk then saw one person, after seeing the Police, started fleeing towards Kodihat, but he was apprehended, who disclosed his name as Billa Paswan. On inquiry, the petitioner could not produce any paper regarding ownership of the said vehicle.

No.62344 of 2018(2) dt.06-10-2018 2/2 Learned counsel for the petitioner submits that, in fact, petitioner is accused in two more cases due that reason, the petitioner has falsely been implicated in this case saying that the motorcycle, which was seized from the possession of the petitioner was theft article. He further submitted that, in fact, the petitioner has purchased the said motorcycle from one Pannalal Sah, son of Sri Dukhhan Sah, Resident of village Achara, P.S. Fulkaha, District-Araria and also got signature of the owner of the motorcycle on the papers required for transfer of ownership, but in the meantime, he was apprehended and the name could not be transferred in respect of the said motorcycle in D.T.O. Office. The petitioner is in custody, in the present case, since 15.04.2018.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Forbesganj P.S.
