====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 14-11-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 467, 468, 471, 420, 379 and 411 of the IPC.

The prosecution story, in brief, is that during the course of checking, the police seized the vehicle of the petitioner. He disclosed that the said vehicle was purchased from Arvind Kumar and Indrajeet Kumar of Mahindra Finance Company, Saguna More, Patna in the year 2015 and the documents have been supplied by them. On verification, it was found that the Registration No. BR-29PA.5999 belongs to Fortuner vehicle which is in the name of Dr. Rajnandan Singh of Siwan and accordingly it is alleged that the vehicle is apparently

Patna High Court CR. MISC. No.66130 of 2019(3) dt.14-11-2019 2/2 stolen one.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 08.06.2019. The petitioner has got no criminal antecedent. The petitioner has been made accused in the present case due to mistake of fact. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is said to be the bonafide purchaser of the vehicle in question. He had no knowledge that the documents of the vehicle were fake documents.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Danapur at Patna, in connection with Dulhin Bazar P.S. Case No. 148 of 2019.
