2. The petitioner seeks bail in connection with Laukahi P.S. Case No. 233 of 2024, instituted for the offences punishable under Sections 126(1), 115(2), 118(1), 117(2), 109, 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that the petitioner along with other co-accused assaulted the informant's father by iron rod, lathi, danda, butt of the gun and fists. It is further alleged that the informant's father was assaulted by the petitioner on his head by means of iron rod and later, doctor declared him dead.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submits that the allegation levelled against the petitioner is general and omnibus in nature. Due to admitted land dispute the petitioner has been falsely implicated in this case. The petitioner is in custody since 25.04.2025 and has got no criminal antecedent. Learned counsel for the petitioner further submits that other co-accused has been granted regular bail by this Court vide order dated 15.09.2025 passed in Cr. Misc. No. 67024 of 2025.

Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner and submits that there is specific allegation against the petitioner of giving iron rod blow on the head of informant's father due to which he died in course of treatment. It is further submitted that post-mortem report of the deceased corroborates with the prosecution case. Hence, the petitioner does not deserve the privilege of bail.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.73250 of 2025(3) dt.02-12-2025 3/3 of the case, nature of accusation and the gravity of the offence, this Court is not inclined to grant bail to the petitioner.

7. The prayer is rejected. The trial Court is directed to expedite the Trial.
