2. The petitioners have prayed for regular bail in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise (Amendment )Act.

3. The case of the prosecution is that altogether 120 liters of country made liquor was recovered from two bikes.

4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. The petitioners are brother and the alleged recovered bike is in the name of their mother. They have been falsely implicated in this case. They have no concern with the alleged liquor. Nothing has been recovered from their possession.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No. 2, Bhojpur at Ara in connection with Shahpur P.S.
