2. The petitioner seeks bail in connection with Khiri More (Imamganj) P.S. Case No. 171 of 2023 dated 10.11.2023 registered for the offences punishable under Sections 385, 387 and 120B of the I.P.C.

3. As per prosecution case, on 05.11.2023, when the informant's son Amit Kumar @ Shashi Kant Kumar went to Vellor for his treatment, in the meantime, on his mobile no. 7992431449, a call was made through Whatsapp No. 7209472595 for demand of rangdari of Rs. 5,00,000/-. It is further alleged that the informant was also threatened of dire-consequence, if he would not fulfill the above demand.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.74968 of 2024(2) dt.18-10-2024 2/2 present case. It is submitted that the petitioner is not named in the F.I.R. His name has transpired in this case in the confessional statement of the co-accused Ranjan Kumar. The charge-sheet has already been submitted against the petitioner. The petitioner has four criminal antecedents as stated in paragraph no. 3 of the bail application. As per impugned order dated 12.09.2024, the petitioner is in custody since 16.07.2024. The co-accused has been granted regular bail by this Court vide order dated 04.07.2024 passed in Cr. Misc. No. 39944 of 2024.

5.Learned A.P.P. for the State has opposed the prayer for bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, let the above named petitioner, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Danapur, Patna in connection with Khiri More (Imamganj) P.S. Case No. 171 of 2023.

7. The application stands allowed.
