JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-07-2022 This writ application has been filed for quashing of the First Information Report being Kotwali P.S. Case No.158 of 2017 registered under Sections 420, 406, 467, 468, 471 and 506 of the Indian Penal Code.

When the matter was taken up for consideration on 22.07.2022 no one had appeared for the petitioner. This Court, however granted one indulgence and adjourned the matter. Today once again no representation has been made on behalf of the petitioner.

Mr. Md. Harun Quareshi, learned AC to SC-1 for the

Patna High Court CR. WJC No.2203 of 2017(14) dt.25-07-2022 2/2 State has informed this Court that the investigation in this case is complete and a chargesheet has already been filed whereupon the court has proceeded.

In the aforesaid view of the matter, this Court is of the considered opinion that the learned court below must proceed with the matter. The interim order dated 13.11.2017 stands vacated.

This writ application is disposed of in want of prosecution, but with liberty to the petitioner that in case he feels aggrieved by the chargesheet and the order taking cognizance, if so advised, he may avail his remedy in accordance with law.
