The petitioners apprehend their arrest in Nawada Town P.S. Case No.824 of 2019 registered under Sections 341, 323, 325, 308 and 379 of the Indian Penal Code. The informant alleged that when the informant was talking for partition of the properties, the petitioners assaulted the informant and his son. Petitioner No.3 is alleged to have assaulted the informant with Samath(a hard blunt object) and others are also alleged to have assaulted the informant and others.

The learned counsel for the petitioners submits that petitioner Nos.1 and 2 are brothers and petitioner No.3 is father

Patna High Court CR. MISC. No.68371 of 2019(2) dt.18-12-2019 2/2 of the informant. The informant got one lacerated wound on his scalp which is superficial and simple in nature. The injury report does not corroborate the allegation of the informant. Some verbal altercation took place for partition of the properties among the sons and father but the informant being son of petitioner No.3 filed false and frivolous case against his brothers and father.

Taking into consideration the facts aforesaid and nature of allegation made against the petitioners and the fact that petitioners are brothers and father of the informant, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No.824 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
