The petitioner seeks bail in a case registered under Sections 395, 397 of the Indian Penal Code and 3 & 4 of Explosive Substance Act. Later on Sections 25(1-b)A, 26, 35 of the Arms Act has been added.

Allegation is 10-15 unknown miscreants on the point of guns looted ornaments and cash from the house of the informant and also assaulted family members.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.07.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional

Patna High Court CR. MISC. No.64275 of 2019(2) dt.22-10-2019 2/2 statement of co-accused. There is no recovery of any incriminating article from the petitioner. The petitioner has not been put on T.I.P. Other co-accused have been granted bail vide Cr.Misc.No.54332 of 2019 and Cr.Misc.No.57051 of 2019. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Lakhisarai in connection with Lakhisarai P.S. case No.211 of 2019.
