Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 18.9.2017 passed in Cr.Misc.No. 42881 of 2017 and allegation against the petitioner is that he has taken the deceased on the assurance of providing him a motorcycle and deceased had gone along with Rs.50,000/- with him and thereafter the deceased was traceless. Submission of learned counsel for the petitioner is that petitioner has been made accused only on the basis of last seen with the deceased and except that there is no other circumstance against him and he is in custody since 8.12.2016 and charge has been framed as yet.

Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.65581 of 2018(2) dt.31-10-2018 2/2 circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga, in connection with Jale P.S.Case No. 211 of 2016, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in disposal of trial and appear in court as and when required, otherwise his bail bond shall be cancelled.
