Case No. 122 of 2019 registered for the offences punishable under Sections 498A, 504, 506, 307, 304B and 34 of the Indian Penal Code.

As per FIR petitioner happens to be husband of the deceased and there is allegation against him that he set the deceased on fire and earlier there is allegation of demand and torture.

Submission of learned counsel for the petitioner is that several witnesses during investigation have categorically stated that she herself set on fire and petitioner was not there and thereafter he went there and tried to save her, which will appear from paragraphs 38, 39, 40, 61 and 62 of the case diary and petitioner is in custody for seven months.

Patna High Court CR. MISC. No.74025 of 2019(4) dt.18-12-2019 2/2 Heard learned APP, who could not controvert the above submission of petitioner.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Naugachia, in connection with Gopalpur P.S. Case No. 122 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he has to co-operate in disposal of trial and appear in the court as and when required.
