====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-11-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner seeks regular bail in connection with Mansurchak P.S. Case No. 23 of 2019 registered under sections 272, 273 IPC and Sections 30, 36, 38, 40, 47 of the Bihar Prohibition and Excise Act, 2016.

The prosecution story, as per first information report, is that the police recovered a total quantity of 539.74 liters of illicit liquor from the State tube well and arrested one Saurabh Kumar. The name of the petitioner and others have been disclosed by the arrested co-accused.

Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case on the

Patna High Court CR. MISC. No.63426 of 2019(3) dt.26-11-2019 2/2 basis of statement made by the arrested co-accused inasmuch as no illicit liquor has been recovered from the conscious possession or the premises belonging to the petitioner. Learned counsel further submits that the arrested co-accused has been granted bail by this Court in Criminal Miscellaneous no. 29219 of 2019 and the petitioner is in custody since 14.08.2019. After having heard learned counsel for the parties and taking into consideration the fact that the petitioner has got no criminal antecedent and the arrested co-accused has been granted bail by this Court, therefore, I am inclined to grant regular bail to the petitioner.

Accordingly, the petitioner, above named, is directed to be released on bail upon furnishing bail bond of Rs. 20,000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd , Additional Sessions Judge cum Special Judge, Excise Act, Begusarai in connection with Mansurchak P.S. Case No. 23 of 2019.
