The petitioner seeks bail in Daudnagar P.S. Case No.57 of 2018 registered under Sections 302, 379, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is not named in the F.I.R. The name of the petitioner figured in the case during the course of investigation and it transpired that the petitioner had telephonic talk with Gauri Shankar who alleged to have killed Sujit Kumar. The learned counsel for the petitioner submits that Gauri Shankar has already been enlarged on bail vide Cr. Misc. No.49249 of 2018. Only allegation against the petitioner is that the petitioner had talk with Gauri Shankar on his mobile prior to the occurrence.

Patna High Court Cr.Misc. No.61469 of 2018 (2) dt.06-10-2018 Considering the facts aforesaid, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad (Bihar) in connection with Daudnagar P.S. Case No.57 of 2018.
