This application is for grant of regular bail in connection with Alamganj P.S.Case No.97 of 2018 dated 3.3.2018 for the offences under Section 379 of the Indian Penal Code. Petitioner is not name dint he FIR and there is allegation of theft of the motorcycle.
Submission of the learned counsel for the petitioner is that except confession there is nothing against the petitioner and the charge-sheet has been submitted. He is in custody since 11.7.2018.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with
Patna High Court Cr.Misc. No.63559 of 2018 (2) dt.25-10-2018 2/2 direction to the learned trial court to ascertain the facts as to whether the charge sheet has been submitted, however, if the charge sheet has been submitted, he shall release the petitioner on bail in connection with Alamganj P.S.Case no.97 of 2018 to his own satisfaction.
With the aforesaid observation, this application is disposed of.
